HUGE VICTORY ON A PRE-TRIAL EVIDENTIARY HEARING!!![]()
My client and his wife, who live near downtown Mt Clemens MI, we’re out for a night of “drinking and not driving“. They live close enough to the entertainment district, that they could walk between there and home, and they intended to go to a couple of bars, have a couple of drinks, and then walk home. Again, with no motor vehicles involved. ![]()
As they walked home, my client’s wife tripped and fell (perhaps because she may have been under the influence, candidly). However, she was then unable to get up, and she repeatedly fell down. The two were close enough to their home, such that the husband ran home, got his car, and drove back to the scene; he simply intended to take her home, to a place of safety.![]()
By that time, the police were there, and they began the process of a drunk driving arrest on my client. (the husband)![]()
My client does not dispute that he was intoxicated at the time of his arrest. However, he maintained that it was necessary to get his wife home, to a place of safety. Naturally, the prosecutor sees this differently, and instead sees this as a crime, for which there is no excuse.![]()
I filed a motion which was heard today, for permission to assert in front of a Macomb County jury, that my clients actions were necessary, and therefore legally excusable.![]()
The short version of this long story is that the court gave me permission to argue “necessity”, is a defense to my client drunk driving charge.![]()

As of today, use of a handheld cell phone, or similar device while driving in Michigan, is illegal (it has always been unsafe)![]()
1st Offense: $100 fine and/or 16 hrs community service
2nd Offense: $250 fine and/or 24 hrs community service
(With further penalties, the more offenses take place)![]()
